Vivek Oberoi's PM Modi biopic: Mumbai and Delhi high court refuse to stay the film

The petitioner has questioned the timing of the film’s release; 5th of April, and suggested that if the film is permitted to release it will give the BJP and Narendra Modi a mileage in the election process of the country that decides the fate of the ruling government and the opposition for a long five years.

In what comes as a major spite of relief to the makers of the PM Narendra Modi biopic; the Bombay and Delhi High Court have snubbed a PIL seeking a stay on the film, stating that the Election Commission (EC) will deal with it. 


The petitioner has questioned the timing of the film's release; 5th of April, and suggested that if the film is permitted to release it will give the BJP and Narendra Modi a mileage in the election process of the country that decides the fate of the ruling government and the opposition for a long five years.


The petitioner; Satish Gaikwad, national president of the Republican Party of India (I), also argued that if permitted to release for public viewing before the elections, the film would violate the model code of conduct imposed by the Election Commission. 


However; a bench of Chief Justice Naresh Patil and Justice N M Jamdar, shunned the PIL saying," We are not going to interfere with it. You go to the censor board or the Election Commission (EC)." The bench also said," The Election Commission has already taken note of the issue and shall deal with it."


Advocate Birendra Saraf; appearing for the filmmakers and actor Vivek Oberoi who will be essaying the Hon. Prime Minister Narendra Modi in the film, said that a reply had already been filed to the EC to which, advocate Pradeep Rajgopal, representing the EC agreed, saying that the representation has already been made to them and the poll body has permitted the release of the movie.


The film's producer, creative director and writer Sandip Ssingh; was quoted saying," We are very happy that finally the justice has been given to the film. We believe in the system and the law. We are hoping to release the film on time now."


Directed by Omung Kumar; the film was first scheduled to release on the 12th April, a day after the completion of the first phase of the General Elections but will now be released on the 5th of April itself, six days before the first phase of the Lok Sabha polls.
